Parent Visas

The Australian Family migration stream aims to reunite immediate and extended family members with their eligible Australian relatives. Applicants wishing to migrate under the Family migration scheme must be sponsored by a close family relative who is an Australian citizen, Australian permanent resident or eligible New Zealand citizen and at least 18 years of age.

Australian Parent Visa

The Parent visa allows parents to migrate to Australia permanently to join their children living in Australia. The Parent visa requires sponsorship from an eligible child in Australia.

The government limits the number of available Parent visas available each program year. Therefore, applicants who apply and meet core criteria for this visa are placed in a global queue.

However, under the Contributory Parent visa program, applicants pay a larger fee with a shorter processing period.

Australian Parent Visa Basic Requirements

In order to apply as a parent, applicants must pass the balance of family test.

Balance of Family

The ‘balance of family’ test applies to all permanent Parent visa applicants and the applicant must demonstrate that they have:

  • at least half of their children living lawfully and permanently in Australia; or
  • more children living lawfully and permanently in Australia than in any one single country overseas.

An Aged Parent visa must be applied for onshore and applicants are required to be in Australia at the time that the visa is granted.

All Australian visa applicants are required to satisfy health and character requirements.

In addition, all parent migrants must be sponsored by their child who must be an Australian citizen, Australian permanent resident or eligible New Zealand citizen.

Applicants are also required to satisfy health and character requirements.

Australian Parent Visa Entitlements

Successful applicants and holders of a Parent visa become permanent residents of Australia.

As a permanent resident, you are entitled to live, work and study in Australia on a permanent basis.

Additional benefits of Australian permanent residence include access to government-subsidised healthcare (Medicare), certain social security benefits and the ability to apply for Australian citizenship.

Australian Aged Parent Visa

Although most other parent visa applications can be only lodged as an offshore applicant, the Aged Parent Visa can be lodged both onshore and offshore.

Australian Aged Parent Visa Basic Requirements

To be eligible to apply for an Aged Parent visa, applicants must meet the age requirement, pass the ‘balance of family’ test and be sponsored by their child who must be an Australian citizen, Australian permanent resident or eligible New Zealand citizen settled in Australia.

Age

An aged parent is one who is old enough to be granted an Australian age pension. For male applicants, the qualifying age is currently 65 years and for female applicants, the qualifying age ranges from 63 to 65 depending on the applicant’s date of birth.

CONTRIBUTORY PARENT VISA (SUBCLASS 143)

This is a permanent visa referred to as a “Contributory” visa. This is because the initial application fee is $4,155 for the first applicant and $2,075 for additional applicant over 18 and $1,040 for additional applicant under 18. However the second instalment for each applicant is $43,600. This visa takes approximately 3.5 to 4.5 years to process and is a permanent visa from approval.

The large “Contribution” of money that is called for upon the second instalment is in order to offset the rights that are awarded to the visa holder under permanent residency such as health care that they have not contributed towards throughout their lives as ordinary Australians have throughout their life by way of tax.

Assurance of Support (AoS)

For this visa, there also is an AoS  requirement which is payable toward time of decision. For two applicants this is currently $14,000. The bond is refunded ten years after you enter Australia as the holder of the contributory parent visa, less any debts owed to the Australian government.

This visa lets you:

  • stay in Australia indefinitely
  • work and study in Australia
  • enrol in Medicare, Australia’s scheme for health-related care and expenses
  • sponsor eligible relatives for permanent residence
  • travel to and from Australia for five years
  • apply for Australian citizenship (once residence requirements have been met)

SPONSORED PARENT (subclass 870) VISA

This is a temporary visa which can be granted up to 5 years and extended for another 5 years. The visa provides parents with a new pathway to temporarily reunite with their children and grandchildren in Australia, while ensuring that taxpayers are not required to cover additional costs.

Requirements:

Sponsored Parent (Temporary) visa applicants must:

  • be sponsored by a person who is an approved parent sponsor
  • be at least 18 years of age
  • be outside Australia (unless invited in writing to apply by the Department), for at least 90 days if the applicant holds or has previously held a Sponsored Parent (Temporary) visa
  • not have engaged in payment for visas conduct
  • provide evidence of access to funds
  • provide evidence of health insurance
  • not have an outstanding public health debt (unless appropriate arrangements have been made to repay the debt)
  • satisfy health, character, and national security requirements.

Family Balance Test

Unlike permanent Parent visas, there is no Balance of Family Test requirement for this visa, meaning a visa applicant is not required to have more than half of their children residing in Australia.

Benefits of this visa

The visa allows parents to remain in Australia for a longer period of time, up to five years at a time without departing. It provides an alternative option to Visitor visas which only allow shorter periods of stay. Parents are still eligible to apply for Visitor visas and/or permanent Parent visas.
